This Privacy Policy explains how ClickMelon, LLC ("ClickMelon," "we," "us," or "our") collects, uses, discloses, and safeguards information in connection with our website at clickmelon.com (the "Site") and our lead generation, database reactivation, and AI automation services (collectively, the "Services").
By using the Site or the Services, you agree to the practices described in this policy. If you do not agree, please do not use the Site or the Services.
1. Who This Policy Covers
This policy applies to two groups:
- Visitors and prospective clients — businesses and individuals who visit our Site or contact us about our Services.
- Client contacts — individuals whose information our clients provide to us so that we can perform outreach on the client's behalf (for example, contacts in a client's CRM). For this group, our client is the "data controller" and we act as a "service provider" / "data processor" handling the data under the client's instructions.
2. Information We Collect
Information you provide directly. When you contact us (for example, by email or by booking a call), we collect your name, email address, phone number, company name, and anything else you choose to share.
Information from our clients. To deliver the Services, our clients share contact records with us, which may include names, email addresses, phone numbers, prior inquiry or purchase history, and engagement history with the client's business.
Information collected automatically. When you visit the Site, we may automatically collect technical data such as IP address, browser type, device information, pages viewed, and referring URLs through cookies and similar technologies.
Communications data. When we conduct SMS and email outreach on a client's behalf, we process message content, delivery status, replies, and opt-out requests.
3. How We Use Information
- To provide, operate, and improve the Services, including AI-powered outreach, lead qualification, and automation workflows.
- To respond to inquiries and communicate with you about our Services.
- To perform outreach and follow-up on behalf of our clients, under their instructions.
- To process and honor opt-out, unsubscribe, and do-not-contact requests.
- To maintain security, prevent fraud and abuse, and comply with legal obligations.
- To analyze Site usage and improve performance.
4. AI and Automated Processing
Our Services use artificial intelligence to draft and personalize outreach messages and to qualify responses through conversation. AI-generated communications are designed to operate within the scope of the outreach our clients authorize. We do not use the contact data our clients provide to train general-purpose AI models for unrelated purposes.
5. SMS and Email Outreach; Consent and Opt-Out
Outreach is conducted on behalf of our clients to contacts the client has a relationship with. We support compliance mechanisms required by applicable law, including the ability to opt out at any time.
- Email: every marketing email includes an unsubscribe link, consistent with the CAN-SPAM Act and similar laws.
- SMS: recipients can reply STOP to opt out of further messages, consistent with the TCPA and carrier requirements. Message and data rates may apply. Reply HELP for help.
Opt-out requests are processed promptly and shared with the relevant client.
6. How We Share Information
We do not sell personal information. We may share information with:
- Service providers who help us operate the Services (for example, messaging platforms, email/SMS delivery providers, hosting, and analytics), bound by confidentiality and data-protection obligations.
- Our clients, when we deliver qualified leads and engagement results back to them.
- Legal and safety recipients, when required by law, subpoena, or to protect rights, safety, and property.
- Business transfers, in connection with a merger, acquisition, or sale of assets.
7. Cookies and Tracking
We use cookies and similar technologies to operate the Site, remember preferences, and understand usage. You can control cookies through your browser settings; disabling them may affect Site functionality.
8. Data Retention
We retain information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Contact data processed on behalf of a client is retained according to that client's instructions and our agreement with them.

We use reasonable administrative, technical, and physical safeguards to protect information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Your Rights
Depending on where you live, you may have rights to access, correct, delete, or restrict the processing of your personal information, or to opt out of certain processing. Residents of California (CCPA/CPRA), the EU/UK (GDPR/UK GDPR), and Canada (PIPEDA/CASL) may have additional rights.

We are based in Utah, United States and may process information in countries other than where you reside. Where required, we use appropriate safeguards for cross-border transfers.
12. Children's Privacy
The Services are not directed to children under 16, and we do not knowingly collect personal information from them.

We may update this Privacy Policy from time to time. Material changes will be reflected by updating the "Last updated" date above.
